All the employees who have worked with an employer for minimum one year, are entitled for end-of-service gratuity benefits. The gratuity is calculated at the time of resignation or termination of the employment.

Who is Entitled for Gratuity in Qatar?

The employee who has worked with an employer/company for one year or longer, is entitled for gratuity in Qatar. Kindly note that the employee is entitled to receive the gratuity benefit at the end of service and not when their employment/job is active.

Who is Not Eligible for Gratuity in Qatar?

The employee who has worked with an employer/company for less than one year, is not eligible for gratuity in Qatar.

For example: An employee has worked with one employer for 10 months and another employer for 8 months in Qatar. Here, the employee has worked for 18 months i.e. more than one year in Qatar but the employee has not completed minimum one year of service with any one employer.

Therefore, the employee is not eligible to receive any amount as gratuity at the end of service.

What is Minimum Gratuity Benefit?

As per Article 54 of Qatar Labour Law: The minimum gratuity benefit is 3 weeks basic salary per year for every employee who has worked with an employer for longer than one year.

It means that the gratuity benefit amount cannot be less than 21 days basic salary of the employee for every completed year of service in Qatar.

If the employer/company has a policy to pay gratuity more than 21 days (3 weeks) basic salary per year, the Qatar Labour Law allows them to pay more. But any employer/company cannot pay less than 3 weeks basic pay as gratuity to their employees.

How to Calculate Gratuity in Qatar

There are two different ways to calculate end-of-service gratuity in Qatar. You can calculate gratuity manually by using the official gratuity calculation formula or you can use the online gratuity calculator Qatar to do the automatic calculation process.

Points to Consider for Qatar Gratuity Calculation

  • For gratuity calculation, the employer shall consider the last basic salary paid to the employee.
  • The employer should calculate 21 days basic salary by considering 30 calendar days per month for gratuity calculation.
  • If the employer/company has a policy to calculate employee benefits based on working days (e.g. 26 working days per month), the Qatar Labour Law allows the employer to calculate gratuity as 21 days basic salary per year using the 26 working days per month.
  • The employer/company who does NOT have a policy of employee benefits calculation on working days, are required to consider 30 days per month to calculate 21 days basic salary and end-of-service gratuity of the employee.
  • The employer must pay end-of-service gratuity as 21 days basic salary for each completed year of service and also for the partial year in proportion to number of months worked by the employee out of 12 months.
  • If the employee owes any amount to the employer, the employer can deduct it from the employee's end-of-service gratuity and pay the remaining gratuity amount.
  • The employer needs to calculate gratuity of an employee on or after termination of the employment contract by one or both parties.

Gratuity Calculation Rules

The Ministry of Labour (MOL), Government of Qatar has updated the End-of-Service Gratuity Calculation Rules in 2024.

According to old rules, the employees were entitled to receive higher amount of gratuity if they work with one employer continuously for longer than 5 years or 10 years but now the rules are changed.

Irrespective of the number of service years, the New Rules say that the employee is entitled to 21 days basic salary as end-of-service gratuity for each completed year of service. The minimum service years to be eligible for gratuity in Qatar is one year for all the employees.

Qatar Gratuity Calculation Formula

According to the Ministry of Labour (MOL), the employer shall pay 21 days basic salary as end-of-service gratuity to the employee for each completed year of service including partial years.

Here is the formula for calculating gratuity in Qatar;

End-of-Service Gratuity = Last Basic Salary x 21 Days/30 Days x Number of Completed Years of Service

For Example:

Mr Rehan joined Jhafra Industry in Qatar on 1st February, 2022 and he resigned on 1st August 2023. His last basic salary was 2000 Riyals. So, let us find out the gratuity benefit amount for Mr Rehan.

Mr Rehan's employment period is 1 year & 6 months i.e. he has completed 1.5 years of service with the Jhafra Industry.

As per Rules, Mr Rehan is entitled for 21 days basic salary as gratuity for his 1.5 years of completed service.

Mr Rehan's Gratuity = Last Basic Salary x 21 Days/30 Days x Number of Completed Years of Service

= 2000 Riyals x 21 Days/30 Days x 1.5 Years

= 2000 x 21/30 x 1.5

= 2100 Riyals

So, Mr Rehan is entitled to receive 2100 Riyals as his end-of-service gratuity and the employer (Jhafra Industry) has to pay it along with salary and other dues.

Do Annual Leaves Affect Gratuity Calculation?

According to the Qatar Labour Law, the employer must consider all annual leaves of the employee in gratuity calculation. The Annual Leave is the right of every employee and therefore all annual leaves are paid leaves in Qatar as per government rules.

So, the annual leaves given to the employee do not affect their end-of-service gratuity calculation. The employer should include annual leave days in completed years of service of the employee for the purpose of gratuity calculation.

Does Unpaid Leave Affect Gratuity Calculation?

Yes, the unpaid leave affects gratuity calculation. The Qatar Labour Law Rules clearly state that the employer shall exclude the unpaid leave days of the employee when calculating the completed years of service for calculation of gratuity.

So, the employees should avoid taking unpaid leaves unnecessarily because these leaves are unpaid and they also affect their end-of-service gratuity benefit.

Can Employer Refuse to Pay Gratuity?

As per Article 61 of Qatar Labour Law: Yes, the employer can refuse to pay gratuity if the employee breaches the employment contract or causes loss to the employer or gets involved in illegal activities or other reasons.

Without a valid reason, the employer cannot terminate the employee and cannot refuse to pay end-of-service gratuity to them. But the employer can refuse to pay gratuity and other dues to the employee for some valid reasons that are mentioned below.

  • The employee has remained absent from work for 7 days without taking leave or informing the HR/employer.
  • The employee's identification and/or nationality documents have turned out as fake.
  • The employee has remained undisciplined at the workplace and is terminated for the disciplinary reason(s).
  • The employee is found under the influence of alcohol or weed or other substances at the workplace.
  • The employee has violated the terms & conditions of the employment contract.
  • The employee has caused a heavy loss to an asset or office equipment.
  • The employee is involved in illegal activities, got arrested and has one or multiple active police cases against them.
  • The employee has tried to attack/assault the employer or the manager or a coworker at the workplace.
  • The employee has shared one or more secrets of the company with other employer/company which is not allowed as per the employment contract and morality.
  • The employee fails to perform their work as stated in the employment contract.

What to do If the Employer Refuse to Pay Gratuity?

If the employer refuses to pay gratuity without a valid, specific reason, the employee must file a complaint against the employer. The employee should contact the relevant department of the Ministry of Labour (MOL) to register a complaint about refusal of end-of-service gratuity payment by the employer.

The labour department will contact the employer to settle the dispute and pay the end-of-service gratuity as per rules. If the employer does not agree then the labour department will take legal action against the employer and the law will force the employer to pay the gratuity to the employee.

Types of Employment Contracts in Qatar

The employers/companies can hire the employees either on a fixed-term contract or an indefinite term contract. The type of employment contract does NOT affect the calculation of gratuity in Qatar.

Fixed-term Contracts

The fixed-term contracts are valid for a certain period with a starting date and an ending date. The fixed-term contracts cannot be longer than five years. At the end of the contract period, the employer and the employee can mutually agree to renew the contract for the same period.

For example: The employer hired an employee under a fixed-term contract of 3 years. On completion of 3 years, the contract can be renewed for another 3 years if both the employer and the employee agree to do it.

Indefinite Term Contracts

The indefinite term contracts come with unlimited validity, these contracts have a starting date but do not have any ending date. Therefore the indefinite term contracts are also known as open ended contracts. The indefinite term contracts do not need renewal.

The employment under an indefinite term contract goes on as long as the employer and the employee want to work with each other. In case the employer or the employee or both of them want to end the employment, they can terminate the contract as per rules.

The rules for calculation of end-of-service gratuity are the same for the employees under fixed-term contracts and indefinite term contracts. It means that a worker's employment contract type does not affect their entitlement or eligibility for gratuity and the gratuity amount.
